Terms and Conditions for The Homefolk Box

Welcome to The Homefolk Box (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at www.thehomefolkbox.com (the “Website”) and any services, products, or subscription boxes (collectively, the “Service”) provided by The Homefolk Box. By accessing or using the Website and/or purchasing any Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use or access the Website or our Service.


1. Definitions

  • “Account” means an individual account created by a user to access certain features of the Website.

  • “Content” refers to all text, images, graphics, audio, video, and other materials provided by us on the Website or in the Service.

  • “Subscription” means a recurring order for one or more Homefolk Box product(s) to be delivered at scheduled intervals (e.g., monthly, quarterly).

  • “User” or “you” means any person or entity accessing or using the Website or the Service.


2. Acceptance of Terms

  1. Binding Agreement. By creating an Account, placing an order, or otherwise using the Website or Service, you acknowledge that you have read, understood, and agree to these Terms, including any policies referenced herein.

  2. Modifications. We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the “Last updated” date at the top of this page. Your continued use of the Website or Service after such modifications constitutes your acceptance of the updated Terms.


3. Eligibility

  • You must be at least 18 years old to register for an Account or place an order. By using the Website or Service, you represent and warrant that you are at least 18 years of age.

  • If you are ordering on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.


4. Account Registration and Security

  1. Account Creation. To access certain features (e.g., subscribing to a box), you will need to create an Account by providing your name, a valid email address, a password, and billing/shipping information.

  2. Accuracy of Information. You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date. We reserve the right to terminate or suspend your Account if any information provided is inaccurate, fraudulent, or incomplete.

  3. Account Security. You are solely responsible for safeguarding your password and for any activity (including purchases) that occurs under your Account. Notify us immediately if you suspect any unauthorized use or breach of your Account.


5. Subscription Service

  1. Subscription Options. The Homefolk Box may offer one-time purchases and/or subscription-based products. Subscription frequency (e.g., monthly or quarterly) and pricing will be indicated at checkout.

  2. Billing & Payment. By subscribing, you authorize us to charge your chosen payment method for each recurring delivery at the then-current subscription price. Subscription renewals will occur automatically on the schedule you selected unless you cancel in accordance with Section 6 below.

  3. Price Changes. We reserve the right to change subscription fees and adjust prices at any time. If there is a price increase, we will notify you at least 30 days before the next billing cycle. You may cancel your subscription to avoid any price changes.

  4. Free Trials & Promotional Offers. Any free trial or promotional offer is limited to one per customer. We reserve the right to refuse or cancel subscriptions associated with promotional misuse, fraud, or errors.


6. Cancellation, Returns, and Refunds

  1. Cancelling Your Subscription. You may cancel at any time by logging into your Account and following the cancellation prompts, or by contacting Customer Support at info@homefolkbox.com Cancellation requests must be submitted at least 7 days before the next billing date to avoid being charged for the subsequent period.

  2. No-Refund Policy for Subscription Boxes. Because The Homefolk Box is a curated, individualized product, once a subscription box is shipped, the order is final and no refunds will be issued. In the event of a missing/damaged item (see Section 8), please refer to the “Damages and Shortages” policy.

  3. Returns. Unless otherwise stated on our Product Return Policy, all sales are final. If you receive a defective or damaged item, please notify us within 7 days of delivery. We will arrange for a replacement or credit at our discretion.

  4. Billing Disputes. If you believe you have been charged in error, contact Customer Support within 30 days of the charge. We will review the issue and, if validated, issue a refund or credit.


7. Shipment and Delivery

  1. Shipping Methods & Rates. We ship domestically within UK and Ireland and select international destinations. Shipping rates and estimated delivery times vary by region and will be displayed at checkout.

  2. Delivery Timeframes. While we strive to meet estimated delivery dates, delays may occur due to carrier issues, customs, weather, or other factors beyond our control. We are not liable for delays caused by third-party carriers.

  3. Risk of Loss. Once an order is shipped and transfers to the carrier, risk of loss or damage passes to you. For any lost or stolen packages, please contact the carrier first; if no resolution is reached, notify us so we can assist in filing a claim.

  4. International Duties & Taxes. For international orders, you are responsible for any customs duties, taxes, or import fees levied by your country. Failure to pay such fees may result in the package being returned; in such cases, you may be responsible for return shipping costs.


8. Damages and Shortages

  1. Reporting. If any item arrives damaged or if your box has missing items, you must notify us within 7 days of delivery at info@homefolkbox.com with photographs of the damaged packaging and items.

  2. Resolution. Upon verification, we will either send a replacement item(s) at no additional cost or issue a credit toward your next box. Requests made after the 7-day window may not be honored.


9. Intellectual Property

  1. Ownership. All content on the Website—including but not limited to text, graphics, logos, images, audio clips, video clips, designs, software, and trademarks—is the property of The Homefolk Box or its licensors and is protected by copyright, trademark, and other intellectual property laws.

  2. Limited License. We grant you a limited, non-exclusive, non-transferable license to access and use the Website and Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Website or Service without our prior written consent.

  3. User-Generated Content. Any content you submit (for example, reviews, testimonials, or photographs), remains your property, but by submitting it, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable license to use, reproduce, adapt, publish, and display that content in connection with the Website and Service.


10. Prohibited Conduct

You agree not to:

  1. Use the Website or Service for any illegal purpose or violate any applicable laws or regulations.

  2. Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

  3. Interfere with or disrupt the integrity or performance of the Website or Service.

  4. Attempt to gain unauthorized access to any portion of the Website, other Accounts, or computer systems.

  5. Use any automated means (e.g., bots, scripts) to scrape or collect data from the Website.

  6. Transmit viruses, worms, malware, or other harmful code.

Violation of any of these prohibitions may result in suspension or termination of your Account and/or legal action.


11. Privacy Policy

12. Disclaimers and Limitation of Liability

  1. Disclaimer of Warranties. THE HOMEFOLK BOX PROVIDES THE WEBSITE AND SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  2. No Guarantee of Results. While we carefully curate each Homefolk Box, we do not guarantee that you will be satisfied with every item. Personal preferences and tastes vary; all purchases and subscriptions are made at your own risk.

  3. Limitation of Liability. IN NO EVENT SHALL THE HOMEFOLK BOX, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.


13. Indemnification

You agree to indemnify, defend, and hold harmless The Homefolk Box, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of:

  1. Your breach of these Terms or violation of any law or third-party right.

  2. Your use of the Website or Service.

  3. Any content you submit (e.g., reviews or comments).

  4. Any claim that your use of the Service infringes on a third party’s rights.


14. Third-Party Links and Services

  1. Third-Party Websites. The Website may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or practices of any third party. Visiting linked websites is at your own risk.

15. Termination

  1. By You. You may terminate your Account at any time by following the cancellation procedures set forth in Section 6.

  2. By Us. We may suspend or terminate your Account, refuse service, or discontinue the Website or Service (or any portion thereof) at any time for any reason, including if we believe you have violated these Terms.

  3. Effect of Termination. Upon termination, your right to access the Website and Service will immediately cease. All provisions of these Terms which by their nature survive termination shall survive, including Sections 4 (Account Security), 7 (Shipment and Delivery), 8 (Damages and Shortages), 9 (Intellectual Property), 11 (Privacy Policy), 12 (Disclaimers and Limitation of Liability), 13 (Indemnification), 15 (Termination), and 17 (Governing Law).


16. Governing Law and Dispute Resolution

  1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of [England and Wales], without regard to its conflict of laws principles.

  2. Jurisdiction. Except as otherwise provided below in mandatory dispute resolution, any legal suit, action, or proceeding arising out of or related to these Terms or the Website shall be instituted exclusively in the courts of [London, England], and each party irrevocably submits to the jurisdiction of such courts.

    • The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.


17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.


18. Waiver

No waiver of any term or condition in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.


19. Entire Agreement

These Terms, together with our Privacy Policy, any additional terms or policies referenced herein, and any order confirmations or other notices we provide in connection with your purchase(s), constitute the entire agreement between you and The Homefolk Box regarding the Website and Service, superseding any prior or contemporaneous agreements, communications, or proposals.
